Worker's Compensation

Under Florida law if you are in the construction industry you are required to carry workers compensation even if you have one employee. If you are in the non-construction industry you are required to carry workers compensation for 3 or more employees.

The standard policy has six parts which is as follows:

Part One - Workers Compensation - Covers bodily injury to an employee resulting from an accident or disease and includes resulting death. In addition, it covers the cost of defending the employer against a claim for these benefits.

Party Two - Employers Liability - Covers the insured for (1) claims by employees for injuries not subject to a workers compensation law; (2) claims by others for the liabilities to insured’s employee’s and (3) claims by relatives for injured employees for consequential damages.

Part Three - Other States - May be utilized to provide automatic coverage in states not listed for Part One coverage. For the coverage to apply, the state must b listed for Part Three coverage.

Part Four - Your Duties of Injury Occurs - Under the workers compensation policy, the employer is required to inform the insurer at once of any injury that occurs which might be covered by the policy. The employer must also provide for immediate medical or other services required by the workers compensation law, give the names and address of the injured persons and witnesses, promptly provide any legal papers pertaining to the claim.

Part Five - Premiums - Provides the insured with information about how the policy premium is calculated. Business and types of work are classified according to their estimated exposure.

Part Six - Conditions - Includes an inspection condition that gives the company the right to inspect the employer’s workplace at any time for the purpose of determining insurability or establishing premium.

Workers Compensation rates are governed by the state and not the individual insurance companies.
